Welcome to TimerCue ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms of Use ("Terms"). Please read these Terms carefully before using the App.

2. License and Usage Rights

2.1 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use on devices you own or control.

2.2 License Restrictions

You may not:

• Modify, reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, or sublicense the App
• Create derivative works based on the App
• Copy, distribute, or publicly display the App
• Remove or modify any copyright notices or other proprietary markings

3. User Responsibilities

3.1 Data Entry and Management

• You are responsible for the accuracy of all data entered into the App
• You should regularly export and backup your data
• You are responsible for managing and securing your exported data

3.2 Acceptable Use

You agree to use the App in compliance with:

• All applicable laws and regulations
• These Terms of Use
• Common standards of acceptable behavior

4. Intellectual Property Rights

4.1 Ownership

• The App, including all content, features, and functionality, is owned by us and is protected by international copyright and other intellectual property laws
• Our trademarks and trade dress may not be used without our prior written permission

4.2 User Content

• You retain ownership of any data you input into the App
• You grant us no rights to your data, as all data remains locally on your device

5. Disclaimers and Limitations

5.1 App Provided "As Is"

• The App is provided "as is" and "as available" without any warranties
• We do not guarantee that the App will be error-free or uninterrupted
• We make no warranties about the accuracy or reliability of the App's functions

5.2 Data and Calculations

• We are not responsible for the accuracy of time calculations
• We do not guarantee the preservation of your data
• You acknowledge that data loss may occur due to device issues, app deletion, or other factors

5.3 Limitation of Liability

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our liability for any direct damages is limited to the amount you paid for the App

5.4 Subscription Service

5.4.1 Subscription Plans

• We offer monthly (€0.99/month) and annual (€8.99/year) subscription options
• New users can enjoy a 14-day free trial
• The trial will automatically convert to a paid subscription unless cancelled

5.4.2 Subscription Renewal

• Subscriptions will automatically renew unless cancelled at least 24 hours before the end of the current period
• Renewal charges will be made through your iTunes account
• You can manage or cancel your subscription in iTunes Settings
• After cancellation, you can continue using the service until the end of your current subscription period

5.4.3 Trial Period

• Each new user is eligible for one 14-day free trial only
• You will be notified 24 hours before the trial period ends
• The trial will automatically convert to a paid subscription if not cancelled

5.4.4 Refund Policy

• Refund requests must be processed through the App Store
• We do not handle refunds directly
• Please refer to Apple's policies for specific refund terms

5.4.5 Price Changes

• We reserve the right to adjust subscription prices
• Price changes will be notified in advance
• Price changes will not affect your current subscription period
• You can cancel your subscription before any price change takes effect

6. Changes and Updates

6.1 Terms Updates

• We may update these Terms at any time
• Continued use of the App after changes constitutes acceptance of the new Terms
• Major changes will be notified through the App Store

6.2 App Updates

• We may release updates to the App
• Updates may modify or remove features
• You are responsible for backing up your data before updates

7. Termination

7.1 Your Rights

• You may terminate use of the App at any time by deleting it
• Deletion of the App will permanently remove all local data

7.2 Our Rights

• We may terminate your license to use the App if you violate these Terms
• We may discontinue the App at any time without notice

8. General Provisions

8.1 Governing Law

• These Terms are governed by German law
• Conflicts of law principles shall not apply

8.2 Severability

• If any provision of these Terms is found invalid, the remaining provisions remain in effect
• Invalid provisions shall be replaced by valid provisions that best accomplish the intended purpose

8.3 Entire Agreement

• These Terms constitute the entire agreement between you and us regarding the App
• No modification of these Terms shall be effective unless published by us
